Your article is very misleading. The former VP was simply responding to Team Obama criticism pertaining to the Bush Administration's lack of a cohesive strategy on Afghanistan. This can be easily solved by releasing the strategy of the Bush Administration that was handed to Team Obama. An ammendment to the FY2010 Defense Appropriation that would not permit anyone doing business with the Dept of Defense to have manditory arbitration on issues like assault and battery. It passed 68-30, guess what party 30 nay votes are members of?

The company is KBR which is part of Halliburton. Halliburton is the company formerly centered in Texas that was in Chapter 11 bankruptcy when Cheney left them to become the VP. Government contracts were channelled to Halliburton often without competitive bidding during the Bush presidency. Once Halliburton was rebuilt with billions of US dollars, they moved to Saudi Arabia to avoid having to pay taxes as a US company.

KBR's contract has a clause stating that all employee issues would be handled by arbitration and, as part of the process, the employee would be silenced from commenting on what happened to them. KBR pointed to this clause to prevent rape victims from pursuing legal action.

You can contract out of or agree not to sue for negligence. In most legal systems you cannot "contract out of" criminal offenses. The offense is against society, not just against the individual. I would have thought a clause in an employment contract requiring an employee to agree to be the victim of a criminal offense would be unenforceable, probably void for illegality.
