Justice Clinton?

BS Top - McKinnon Hillary Clinton Brendan Hoffman / Getty Images It’s not as far-fetched as you might think. Mark McKinnon and Myra Adams on how Supreme Court retirements could persuade the secretary of State to take a high-court seat.

The political bombshell of the year could turn out to be Supreme Court Justice Hillary Clinton.

Don’t laugh. It’s politics.  Stuff happens. And a lot stranger stuff has happened in recent years.  Two words.  Sarah Palin.

Last week, ABC News reported: “Lawyers for President Obama have been working behind the scenes to prepare for the possibility of one, and maybe two Supreme Court vacancies this spring. Court watchers believe two of the more liberal members of the court, Justices John Paul Stevens and Ruth Bader Ginsburg, could decide to step aside for reasons of age and health. That would give the president his second and third chance to shape his legacy on the Supreme Court.”

In one stroke, Obama would eliminate any remaining bad feelings—and become a Hillaryland hero.

Given the Clintons ambition for power, most would agree that Hillary doesn’t see secretary of State as the final chapter in her career. Certainly she’d like to be president.  But increasingly, she has to view that prospect as a declining one. As tough as the Clintons are, the book Game Change provides a pretty good insight into just how much that campaign took out of her. The prospect of going through that kind of microwave experience again can’t be terribly attractive.  Although, one thing we do know about the Clintons when it comes to the presidency: they never quit.

Some have suggested Hillary play musical chairs with Joe Biden in a second term. Biden actually wanted to be secretary of State more than he wanted to be vice president. So, he’d probably be game. The problem with this scenario is that in terms of power and influence, the veep slot would be step down for Hillary. And Team Obama never liked the idea of giving Bill Clinton entrée to meddle around the familiar old 18 acres.  On the other hand, the surest route to a party nomination is to launch your candidacy from the cat bird’s seat of the vice presidency.

But if in the end if it’s about what is realistic, and how Hillary could have the greatest impact on society, most would agree she could have the greatest political influence by hanging around for a couple of decades casting votes and writing opinions on the Supreme Court.

Given the political physics of the country these days, Hillary has probably concluded that things are unlikely to get much better for Democrats anytime soon. So Obama is either a one-term president, or limps through a second term only to see Republicans recapture the presidency in 2016. Either way, it doesn’t realistically look Clinton would have a shot until 2020 at the earliest.

So, we understand why Hillary might want the supreme gig. But, why would Obama consider her?

One possibility: legacy. As popular as Obama is, and as many votes as he received in 2008, he still stepped over Clinton to get to the throne.  And a lot of woman haven’t forgotten or forgiven. In one stroke, he would eliminate any remaining bad feelings and would become a Hillaryland hero.

Stripping away the drama, the politics and psychobabble, she’d be a great choice for Obama and the Democrats.  She’s as smart and as qualified as any prospect her party could nominate.

But, would any Republicans support her?

There would be fireworks, for sure. Partisan hell would break loose. Imagine Rush, Hannity, Coulter et al.  What a field day.

But, I’m guessing there would be enough Republicans who would support her because: (a) they actually like and respect her having served with her and seen how hard she works and how smart she is; and (b) they have some ambition to run for president themselves and they’d just as soon see her out of the picture.

This is not a conventional prediction. But the fun thing about politics is how often the conventional wisdom gets tossed on its head. And when you sort through all the angles on this one, Madame Justice Clinton is not really so far-fetched.

It would be funny to watch the GOP punditry switch from back to total Hillary hate from Hillary love affair at the drop of a hat. They have shown themselves to be devoid of basic shame in political calculation.

Don't confuse the level of angst with Obama to the numbers represented by the more level-headed who think he is trying to do a good job. And this includes both Democrats and Republicans. Loud doesn't mean ore support.
It just means loud.

1. daily kos does not count as a real poll.
2. 53% is a pretty freaking lousy rating but in liberalism I guess your scaling.
3. his actual numbers are in the mid 40's pony.

I'm guessing that 53% is better than our previous President had in the last 3 years of his presidency (let's say from roughly post-Katrina time period to his leaving office).
Also, we'll stop quoting Daily Kos, if you'll stop pretending that Michelle Bachmann makes any GD sense. Deal?

Republicans would vote "no," of course. Like every thing else they do in opposition to level-headedness, they wouldn't feel obligated to have a legitimate reason. But it would be interesting to see how they dealt with the public's support of Hillary--and what effects on their party might come from their opposition.

And what is the guarantee that someone younger would not get sick or
incapacitated? Clinton would make a superb Supreme. And, the longer the
Obama Presidency dithers on, the more evident it becomes that she would have been a far better President.

Probably think it should be a 'male' too. Young, male...perhaps even white is your preference, but definitely NOT a older woman.

This is the litmus test for the Party of Obama.

Sorry to break the news to you, but you represent only a small portion of Clinton supporters- the bitter, emotionally retarded ones.

I worked with plenty of gracious and hard-working people at my local Obama campaign office during the general who were Clinton primary supporters.

NO ONE cares that you still hate Obama. Time to grow up and move on.

|
11:24 am, Feb 9, 2010

DKJamal

No, you're right. Most Clinton voters have jumped off the Obama sinking ship -- RealClearPolitics has a good article up right now about it.

They're why Obama's approval ratings have collapsed.

|
12:31 pm, Feb 9, 2010

AliceJ

I supported Hillary in the Primary up to the very end. I supported Obama in the General and was overjoyed when he become President. I am disappointed in him in many ways but I DO NOT EVER think of him in the terms you describe, and I have not jumped off his ship nor have any of the Hillary supporters that I know personally.

In a recent interview (with Candy Crowley?), Hillary indicated she would not run for President again and that she might not want to stay as Sec. of State, if Obama gets a second term. Too exhausting, she said. So Supreme Court speculation may well be on target. I would be thrilled.

It's really sad we have to keep rehashing this, but if you're going to bring it up, the facts straight.

Everyone knew the Michigan Dem primary was not going to count by the party rules, because it was held before the allowed date. Republicans decided the penalize the state by giving only 1/2 the seats, Democratic party rules decided to seat no delegates. Hillary chose to leave her name on the ballot anyway and try to get the Dem party rules changed after the fact. If you want to blame anyone for Michigan's votes not counting, the only people to blame are the state legislators who moved up the primaries.

I would say that her hopes for POTUS are toast. She is part of the Obama Administration and unless things turn around economically, he is a one termer a la Jimmy Carter. She in turn will be tainted by this administration and will be unelectable. I don't think she is known as having a great legal mind. I recall her earlier legal work as allowing children to sue their parents. She is polarizing despite people having sympathy for her because of her husband's humiliating affairs all these years.

That is absolute folly! As CommonSensePleeze said we need someone younger. Obama would never waste a SCOTUS pick on someone in her 60s. The majority on the court were nominated at ages 50-55. Thomas was 43, and Ginsberg was 60. Clinton is 62 and counting. You want your picks to stay on the court for as long as possible.

A private bedroom on the plane, its just like when I used to get stuck at O'Hare when the last flight was cancelled because of the snow and I had to sleep in those plastic seats. To all of those wishing that Obama fail, hence a one-term President, he is pissing off the far right and left, therefore is doing the right things to bring this country out of the mess the Republicans made of things. The whine that he can not fix everything in a year that it took them 8 years to create, even though he has a Congress and now a Supreme Court that are bought off, will not stop this recovery that is taking place. Of Course no one, including national media, will give him credit for a job well done. They will find some small thing to whine about.

Hillary will get an appoint to the Supreme Court if she wants it. I hope that she wants it.

Long live America and President Obama and his policies and Hillary Clinton! Down with America's haters! Flush them away!

This is already a failed presidency. Wishing played no part in the disasters Obama brought on himself and the nation. In retrospect, he probably didn't expect to win. He had no coherent plan. He and his appalling team of advisers lurch from crisis to crisis, driven by extremist ideology, fueled by arrogance and ignorance.

I wonder which planet you live on. The national media still has its collective blinkers on but they would have to be blind, deaf and mute if they could find only small things to whine about. The blunders are huge and continuing and can be recounted by men and women in the street as their daily existence and security is diminished.

The death knell of this administration will be the tax increases about which Obama now claims to be "agnostic". And that would be the good news. The bad news would be further attacks by the terrorists whose existence and capacity Obama and his advisers seem unable to acknowledge.
