Rachel Mitchell, the sex-crimes prosecutor brought in by Senate Judiciary Committee Republicans to question Christine Blasey Ford, has said a “reasonable prosecutor” would not bring a case against Brett Kavanaugh based on the evidence presented to the panel last week. In a five-page memorandum to Republican senators, reported by CNN, Mitchell, who was widely lambasted for her performance, cites inconsistencies between Ford’s statements about the alleged assault to the committee, The Washington Post, and her therapist. Mitchell also says Ford’s inability to recall details such as how she got to the party would count against her. She writes: “A ‘he said, she said’ case is incredibly difficult to prove. But this case is even weaker than that… Dr. Ford identified other witnesses to the event, and those witnesses either refuted her allegations or failed to corroborate them.” However, Mitchell also notes, “A Senate confirmation hearing is not a trial, especially not a prosecution.”
