NEWSWEEK & THE DAILY BEAST—OPEN HANDS PRIZE
FOR COMMENTARY IN SOUTH ASIA

OFFICIAL RULES

1.    NO PURCHASE IS NECESSARY. NOMINEE MUST BE 18 YEARS OF AGE OR OLDER AND LEGALLY PERMITTED TO TRAVEL TO AND RESIDE FOR A MONTH IN THE UNITED STATES TO QUALIFY. NOMINEE MUST BE A COLUMNIST, JOURNALIST, OR WRITER BASED IN AND WRITING REGULARLY IN THE ENGLISH LANGUAGE ABOUT ONE OF THE FOLLOWING COUNTRIES TO QUALIFY: AFGHANISTAN, PAKISTAN, INDIA, NEPAL, BHUTAN, SRI LANKA, OR BANGLADESH (COLLECTIVELY, “SOUTH ASIA”). THIS COMMENTARY PRIZE PROGRAM IS VOID WHERE PROHIBITED BY LAW.

3.    EMPLOYEES AND IMMEDIATE FAMILY MEMBERS OF EMPLOYEES OF THE NEWSWEEK DAILY BEAST COMPANY, THE OPEN HANDS INITIATIVE, AND THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, AND SUBSIDIARIES (COLLECTIVELY, THE “SPONSORS”) ARE NOT ELIGIBLE TO PARTICIPATE IN THIS COMMENTARY PRIZE PROGRAM.

4.    THERE IS ONE WAY TO BE ENTERED IN THIS COMMENTARY PRIZE PROGRAM. BEGINNING WEDNESDAY, APRIL 18, 2012, JOURNALISTS, EDITORS, PUBLISHERS, AND WRITERS IN SOUTH ASIA (“NOMINATING PARTY”) MAY NOMINATE AN ENGLISH-LANGUAGE COLUMNIST OR JOURNALIST (“NOMINEE”) BY TRANSMITTING TO COMMENTARYPRIZE@NEWSWEEKDAILYBEAST.COM THE FOLLOWING MATERIAL: (A) BETWEEN THREE (3) TO FIVE (5) SAMPLES OF THE NOMINEE’S WORK; AND (B) A BRIEF LETTER EXPLAINING WHY THE NOMINEE DESERVES TO WIN. A NOMINATING PARTY MAY NOMINATE HIMSELF OR HERSELF AS NOMINEE (I.E., A JOURNALIST MAY SELF-NOMINATE). ONLY WRITING SAMPLES WRITTEN WITHIN A YEAR OF SUBMISSION WILL BE ELIGIBLE FOR CONSIDERATION.  ALL MATERIAL MUST BE SUBMITTED IN ORDER FOR A NOMINEE TO QUALIFY. SPONSORS ARE NOT RESPONSIBLE FOR LOST, LATE, ILLEGIBLE, MISDIRECTED OR MUTILATED ENTRIES, INCLUDING DUE TO TELEPHONE, COMPUTER SYSTEM, HARDWARE, SOFTWARE, OR NETWORK FAILURES OF ANY KIND.  BY SUBMITTING AN ENTRY, NOMINATING PARTY AGREES TO BE BOUND BY THESE RULES. BY TAKING ANY ACTION INDICATING ACCEPTANCE OF NOMINATION OR INTENT TO PARTICIPATE, WHETHER EXPRESS OR IMPLIED, NOMINEE AGREES TO BE BOUND BY THESE OFFICIAL RULES.  FAILURE TO COMPLY WITH THE OFFICIAL RULES MAY RESULT IN DISQUALIFICATION.

5.    INFORMATION SUBMITTED IN CONNECTION WITH THE COMMENTARY PRIZE PROGRAM WILL BE TREATED IN ACCORDANCE WITH THESE OFFICIAL RULES AND THE NEWSWEEK DAILY BEAST COMPANY PRIVACY POLICY LOCATED AT HTTP://WWW.THEDAILYBEAST.COM/COMPANY/PRIVACY-POLICY.HTML. BY TRANSMITTING WRITING SAMPLES, THE NOMINATING PARTY WARRANTS THAT IT IS PERMISSIBLE FOR SPONSORS TO POSSESS AND REPRODUCE, IN WHOLE OR IN PART, THE WRITING SAMPLES FOR THE LIMITED PURPOSE OF EVALUATING WHETHER NOMINEE SHOULD BE THE WINNER; SPONSORS WILL NOT CLAIM ANY OTHER RIGHTS IN THE WRITING SAMPLES OR USE THEM FOR ANY PURPOSE OTHER THAN EVALUATION OF THE NOMINEE. THE NOMINATING PARTY AGREES TO DEFEND, INDEMNIFY, AND HOLD HARMLESS SPONSORS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AND EMPLOYEES FROM ALL DAMAGES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE OUTSIDE ATTORNEYS FEES AND COSTS) ARISING OUT OF OR IN CONNECTION WITH SPONSORS’ USE OR REPRODUCTION OF THE WRITING SAMPLES AS PERMITTED HEREIN.

6.    NOMINATING PARTIES AGREE NOT TO UPLOAD, POST OR TRANSMIT ANY MATERIALS THAT CONTAIN ANY COMPUTER VIRUSES, EASTER EGGS, WORMS, TROJAN HORSES OR OTHER HARMFUL COMPONENT OR PROGRAMMING ROUTINES THAT ARE INTENDED TO DAMAGE, DETRIMENTALLY INTERFERE WITH, SURREPTITIOUSLY INTERCEPT OR EXPROPRIATE ANY SYSTEM, DATA OR PERSONAL INFORMATION. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE OPERATION OF THE COMMENTARY PRIZE PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY PERSON WHO MAKES SUCH ATTEMPT(S).

7.    ENTRIES ARE DUE NO LATER THAN FRIDAY, MAY 18, 2012.  ENTRIES WILL BE JUDGED BY A PANEL OF PROMINENT INTERNATIONAL JOURNALISTS AND MEDIA EXPERTS ACCORDING TO THE QUALITY OF THE ENTRANT’S WRITING, JOURNALISM, AND COMMENTARY, AS WELL AS THE ENTRANT’S COMMITMENT TO PURSUING QUALITY JOURNALISM CONCERNING SOUTH ASIA, AS DEMONSTRATED IN THE WRITING SAMPLES, COVER LETTER, AND OTHER MATERIAL THE PANEL DEEMS RELEVANT.  THE MEMBERS OF THE PANEL MAY INCLUDE, BUT NOT BE LIMITED TO, WRITER AND HISTORIAN WILLIAM DALRYMPLE, EDITOR OF NEWSWEEK INTERNATIONAL TUNKU VARADARAJAN, NEWSWEEK & THE DAILY BEAST BOOKS EDITOR LUCAS WITTMANN, AND AUTHOR AND JOURNALIST SIR HAROLD EVANS.

8.    WHEN THE PANEL SELECTS NOMINEES TO BE POTENTIAL FINALISTS, IT WILL CONTACT THE SELECTED NOMINEES.  TO BE A FINALIST, THE NOMINEE MUST AGREE TO ATTEND AND PARTICIPATE IN A PRIZE CEREMONY HELD AT THE ASIA SOCIETY OF NEW YORK ON JUNE 20, 2012, WITH REASONABLE TRAVEL EXPENSES AND ACCOMMODATIONS PAID FOR AND ARRANGED BY, AND IN THE SOLE DISCRETION OF, SPONSORS, INCLUDING ROUND TRIP AIR TRAVEL FROM AN AIRPORT IN THE COUNTRY IN SOUTH ASIA IN WHICH THE SELECTED NOMINEE IS BASED TO NEW YORK CITY. IF THE NOMINEE ACCEPTS, HE OR SHE IS A FINALIST.  BY ACCEPTING FINALIST STATUS, A NOMINEE AGREES THAT HE/SHE MEETS ALL QUALIFICATIONS FOR PARTICIPATION AND FOR WINNING AS SET FORTH HEREIN.  THE PANEL MAY SELECT ANY NUMBER OF FINALISTS IN THE SOLE DISCRETION OF THE PANEL AND THE SPONSORS.  FINALISTS WILL BE ANNOUNCED PUBLICLY ON OR BEFORE MAY 30, 2012.

9.    THE WINNER WILL BE SELECTED BY THE PANEL FROM AMONG THE FINALISTS ACCORDING TO THE SAME CRITERIA BY WHICH THE FINALISTS WERE SELECTED. THE WINNER WILL BE ANNOUNCED AT THE PRIZE CEREMONY ON JUNE 20, 2012. LIMIT AT MOST ONE WINNER. IF THE SPONSORS FIND IN THEIR SOLE JUDGMENT THAT NO QUALIFIED FINALIST MEETS THE CRITERIA FOR WINNING SPECIFIED HEREIN, THEN THEY MAY AT THEIR DISCRETION DECLINE TO NAME A WINNER. 

10.    THE WINNER RECEIVES THE FOLLOWING PRIZES: (1) A $25,000 CASH PRIZE (THE “CASH PRIZE”); (2) A ONE-MONTH RESIDENCY AT THE NORMAN MAILER CENTER AND WRITERS COLONY IN PROVINCETOWN, MASSACHUSETTS (THE “RESIDENCY”); AND (3) A BI-WEEKLY COLUMN FOR ONE YEAR ON THE DAILY BEAST WEBSITE (THE “DB COLUMN”).  WINNER WILL NOT RECEIVE ANY COMPENSATION FOR THE DB COLUMN.  EDITORS OF THE DAILY BEAST MAY REVISE IN ANY MANNER, DELAY PUBLICATION, OR DECLINE TO PUBLISH ANY MATERIAL SUBMITTED FOR THE DB COLUMN, OR MAY DISCONTINUE OR SUSPEND THE DB COLUMN, IN THEIR SOLE DISCRETION FOR ANY REASON. WINNER ASSIGNS ALL RIGHTS IN THE DB COLUMN AND ALL WRITTEN OR OTHER MATERIAL PREPARED THEREFOR EXCLUSIVELY TO THE NEWSWEEK DAILY BEAST COMPANY. 

11.    ODDS OF WINNING DEPEND ON THE NUMBER OF ENTRIES RECEIVED.

12.    WINNER WILL BE SOLELY RESPONSIBLE FOR ANY AND ALL LOCAL, STATE AND NATIONAL OR FEDERAL TAXES, AS WELL AS OTHER COSTS ASSOCIATED WITH PRIZES NOT SPECIFIED AS BEING PROVIDED BY SPONSORS, INCLUDING BUT NOT LIMITED TO TRANSPORTATION COSTS NOT SPECIFIED AS BEING PROVIDED BY SPONSORS AND GRATUITIES AND OTHER ITEMS OF AN INCIDENTAL NATURE. THE NEWSWEEK DAILY BEAST COMPANY WILL REPORT ANY INDIVIDUAL WINNINGS TO PERTINENT TAX AUTHORITIES AS REQUIRED BY LAW.  PRIZE(S) MAY NOT BE EXCHANGED FOR CASH OR ANY OTHER CONSIDERATION.

13.    WINNER AND FINALISTS AGREE TO THE USE OF HIS/HER NAME AND LIKENESS IN PUBLICITY WITHOUT ANY ADDITIONAL COMPENSATION, EXCEPT WHERE PROHIBITED BY LAW.  BY ACCEPTING WINNING IN THIS COMMENTARY PRIZE PROGRAM, THE WINNER AND FINALISTS ACKNOWLEDGES THAT THE NEWSWEEK DAILY BEAST COMPANY AND ALL OTHER SPONSORS AND VENUES HAVE THE RIGHT TO PUBLICIZE AND BROADCAST HIS/HER/THEIR NAME, VOICE AND LIKENESS, THE FACT THAT HE/SHE WON OR WAS A FINALIST, AND ALL MATTERS INCIDENTAL THERETO.

14.    NOMINATING PARTIES AND PARTICIPATING NOMINEES (INCLUDING FINALISTS AND THE WINNER) FOREVER DISCHARGE AND RELEASE SPONSORS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SUBSIDIARIES FROM ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, SUITS, AND DEMANDS OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE COMMENTARY PRIZE PROGRAM, INCLUDING, WITHOUT LIMITATION, RESPONSIBILITY FOR PROPERTY DAMAGE, LOSS OF LIFE OR PERSONAL INJURY RESULTING FROM OR IN CONNECTION WITH PARTICIPATING IN THE COMMENTARY PRIZE PROGRAM OR FROM OR IN CONNECTION WITH USE OR RECEIPT OF THE PRIZES, HOWEVER CAUSED.

15.    APPROPRIATE GOVERNMENT-ISSUED PICTURE IDENTIFICATION MAY BE REQUIRED TO CLAIM THE PRIZES. THE WINNER WILL BE REQUIRED TO EXECUTE AND RETURN A RELEASE AND/OR AFFIDAVIT OF ELIGIBILITY WITHIN ONE MONTH OF DATE OF NOTIFICATION OF WINNING WILL BE FORFEITED. WINNER(S) MUST ATTEND THE PRIZE CEREMONY IN NEW YORK ON JUNE 20, 2012 OR ALL PRIZES WILL BE FORFEITED. WINNER MUST CLAIM OTHER PRIZES WITHIN 30 DAYS OF THE CEREMONY OR ANY PRIZE NOT CLAIMED WILL BE FORFEITED.

16.    IN THE EVENT OF A DISPUTE, ALL DECISIONS MADE BY THE NEWSWEEK DAILY BEAST COMPANY ARE FINAL AND BINDING. IN THE EVENT THE WINNER IS DEEMED INELIGIBLE OR FAILS TO COMPLETE THE REQUIRED RELEASE AND/OR AFFIDAVIT, SPONSORS RESERVE THE RIGHT TO CHOOSE AN ALTERNATE WINNER FROM THE REMAINING ELIGIBLE ENTRIES.

17.    RULES ARE SUBJECT TO MODIFICATION BY THE NEWSWEEK DAILY BEAST COMPANY.
