The Supreme Court upheld the legality of using independent redistricting commissions Monday, in a 5-4 decision where Justice Anthony Kennedy joined the liberal wing. Arizona State Legislature v. Arizona Independent Redistricting Commission concerned a redistricting commission where two Democrat-appointed and two Republican-appointed commissioners selected their fifth member, and Republicans said the commission favored Democrats. The court also ruled that midazolam, a drug used in some flawed lethal injections, is not unconstitutional. The court also found that the Environmental Protection Agency must take costs to industry into account when regulating emissions.
