The Obama administration says that an injunction to immediately cancel Don’t Ask, Don’t Tell would hurt the military’s ability to fight the war, according to its federal court filing in California. The administration asked U.S. District Judge Virginia A. Phillips to not issue the injunction, despite her ruling this month that the anti-gay policy is unconstitutional and has a “direct and deleterious effect” on the military. The suit was filed by the Log Cabin Republicans, whose 19,000 members include current and former servicemembers, so the Justice Department asked the judge to apply any injunction only to members of that group.
