The nasty battle between partisan pundits over which Supreme Court justices should recuse themselves from the looming "Obamacare" case is a farce, writes former attorney general Michael B. Mukasey in The Wall Street Journal. The left wants Clarence Thomas out, and the right wants Elena Kagan out, but Mukasey says these crusades are more about the partisanization of the Supreme Court than true legal offenses. "The persistence of recusal issues appears to have little to do with the legal merits—there aren't any—but a great deal to do with the process of how we have selected and rejected candidates for judicial office in the past few decades."
