In a June 2 detention hearing, U.S. District Court Judge Lynn N. Hughes compared the fear of people joining ISIS today to the fear of people joining the Communist Party during the Cold War. “You can’t generalize... to everybody who says ‘ISIS.’ That was the call of the communist[s] actually all along...” Hughes told prosecutors in the case of Asher Khan, who was charged this year with conspiracy and attempts to provide material support to ISIS. “Your honor, communism wasn’t attached to the seeking of matyrdom.” The judge decided Khan await trial under house arrest rather than behind bars.
