Kagan Filibuster Still an Option

Not So Fast

Sen. McConnell signals shift in GOP position.

Two days after the Clinton Foundation Library released a trove of Elena Kagan's White House emails, Senate Minority Leader Mitch McConnell (R-KY) acknowledged on Fox News Sunday that a GOP filibuster of her Supreme Court nomination is still on the table. Several Republican senators, including McConnell, have previously stated that a filibuster would be unlikely. "It is possible, but entirely too early to know whether that would be appropriate," McConnell said, adding that he finds the nominee's position on the First Amendment "quite troubling." He added, "The option is open under the Senate procedures, but to predict that that might happen at this stage of the game is entirely premature."
