However, before initiating the talks, Goldman will probably offer “a sweeping defense of the firm’s actions.” Gasparino says the bank believes the SEC’s charges are baseless but doesn’t want to risk the bad publicity of a drawn-out battle. "We can't be going to war with the SEC," says one senior executive at the firm.
