Attorney General Jeff Sessions said the Justice Department will use “every lawful measure” to uphold the administration’s right to rescind the Deferred Action for Childhood Arrivals program, according to a Monday press release. Sessions accused Judge John Bates of the Federal District Court for the District of Columbia of “improperly” using judicial power to “steer, enjoin, modify, and direct executive policy.” “The executive branch’s authority to simply rescind a policy… is clearly established,” Sessions said. The attorney general also accused the Obama administration, which implemented DACA, of violating “its duty to enforce our immigration laws by directing and implementing a categorical, multipronged non-enforcement immigration policy for a massive group of illegal aliens.” Judge Bates ruled last week that the Trump administration must reinstate DACA protections because they “failed to justify eliminating it.”
