An unarmed black man was fatally shot at least 10 times in a California Walmart parking lot and didn't receive medical treatment for “a great deal of time,” the family’s lawyer told CBS News. Police say the man, 26-year-old Diante Yarber, hit two patrol cars with his own vehicle, prompting four officers to open fire because they “feared for their safety and the safety of others.” A preliminary autopsy conducted by a private medical examiner concluded that Yarber was shot 10 times and choked on his own blood. On April 5th, police received a call about a suspicious vehicle in the Walmart parking lot and found Yarber, who was wanted for car theft, in a Mustang. When police told Yarber to step out of the car, he hit two patrol vehicles. Police then fired about 30 rounds at the car, hitting the diver and injuring two other passengers, BuzzFeed News reported. “The injuries are consistent with defensive wounds...as he was shielding himself and trying to escape the onslaught of bullets,” the Yarber family’s lawyer S. Lee Merritt said. CBS Los Angeles reported that the family is suing the department for excessive force, while police claim their officers feared for their safety and the safety of others in the parking lot.
