The legal assault on Don’t Ask, Don’t Tell continues: A federal district court judge in Tacoma, Washington, has ordered that a former Air Force flight nurse be reinstated after she was dismissed for revealing that she is a lesbian. If Major Margaret Witt, 46, is given her job back as planned—the judge ordered that it be done “at the earliest possible moment”—she will become the first openly homosexual member to legally serve in the U.S. military. Witt was represented by the American Civil Liberties Union; Air Force lawyers countered that the policy should be followed in order to maintain morale and order. The ruling comes just weeks after a federal judge in California also struck down DADT as unconstitutional. The U.S. Senate, however, was prevented from acting on the policy’s repeal due to a Republican filibuster.
