Elena Kagan knows how the game is played: She declined to name her political leanings to the Senate on Tuesday, even though she wrote an article 15 years ago arguing that justices should present such views at confirmation hearings. Kagan said that the article was a “little bit off” and that she would consider each case as “fairly and objectively as I can.”
