White House counsel Don McGahn is reported to be planning to step down this fall, and is tipped to be succeeded by Emmet Flood—a lawyer recently brought on for President Trump who also advised Bill Clinton during his impeachment hearings. Axios reports McGhan will step down either after Brett Kavanaugh is confirmed to the Supreme Court or after the midterm elections. Trump is said to not have settled on a successor, but Flood, who worked as special counsel in the George W. Bush administration, is reported to be the top internal choice. McGhan’s replacement could be in charge of handling subpoenas for documents and testimony if Democrats win control of the House in the midterms, and could end up in a constitutional fight if the White House ends up challenging special counsel Robert Mueller. McGhan has reportedly said privately, despite planning to step down, that he expects to continue to be of assistance to the president through the re-election campaign.
