A California porno producer drew the ire of one of Vermont’s most laidback companies on Wednesday when Ben & Jerry’s sued the maker of Ben & Cherry’s DVDs for trademark infringement. The ice cream company, famous for its punny headlines, said that the triple-X video maker created “titles and themes that are based on and deliberately trade upon” the ice creamery’s own distinctive branding. The papers filed in Manhattan federal court say that a comparison of the DVDs and Ben & Jerry’s own packing demonstrates a “blatant and outrageous copying and misappropriation of the Ben & Jerry’s intellectual property.” As for the porn company’s smutty plays on “Chocolate Fudge Brownie” and “Peanut Butter Cup,” we leave those to the imagination.
