NJ Sues Preschool for Expelling Down Syndrome Student

The New Jersey Attorney General’s Office has filed a lawsuit against a preschool it says expelled a student with Down syndrome. According to the lawsuit, the Chesterbrook Academy in Moorestown discriminated against the 3-year-old student by expelling her for not being fully potty-trained but allowing others who were not fully trained to stay. The school allegedly placed the girl in an intermediate class without providing proper accommodations—and then kicked her out. The preschool is part of a national chain run by Nobel Learning Communities, which said in a statement Wednesday that it’s dedicated to a “diverse student population.” The school has not commented directly on the case, and the identity of the expelled toddler has not been released.
