A jury on Monday decided that James Holmes, convicted of murdering 12 people inside an Aurora, Colorado, movie theater three years ago, will not necessarily be spared from the death penalty. “Mitiating factors” like mental illness did not outweigh “aggravating factors” proven beyond a reasonable doubt by prosecutors, such as counts of first-degree murder. Another sentencing trial will determine whether Holmes gets life without parole or the death penalty.
