The Obama administration promised to respond by Thursday to a request by the U.S. Court of Appeals for the Fifth Circuit and formally outline its beliefs about whether the courts have a right to strike down a federal law. The request came after President Obama said earlier this week that it would be “unprecedented” for the Supreme Court to overturn a law that had been passed by a democratically elected Congress. Attorney General Eric Holder called those remarks “appropriate.”
