Lindsay Lohan will be back in court Friday because she failed a drug test, but the actress probably won’t have to go back to jail. Los Angeles Superior Court Judge Elden S. Fox has said he’d put Lohan in jail for 30 days every time she skipped or failed a drug test, but that punishment will have to be delayed until a formal hearing to revoke probation. If Fox could have sent Lohan to jail without setting bail, she’d have had to serve a full 30-day sentence. But Fox will have to set bail at Friday’s hearing because the charges are misdemeanors, and a bail bondsman would likely immediately be there to spring the star. The probation hearing is set for next month, and that’s when Fox could hand down the 30-day sentence. But jail overcrowding means Lohan would probably be behind bars for hours, not weeks.
