Tucson gunman Jared Lee Loughner has been indicted by a federal grand jury in Arizona on 49 counts for his January rampage that wounded 13 people, including Rep. Gabrielle Giffords, and left six dead, including a chief federal district judge. The indictment on Friday was unique since it added 46 additional federal charges to the case against Loughner, claiming that his crime, at the Safeway where Giffords was meeting with constituents, occurred on protected federal ground. Loughner, 22, faces the death penalty if convicted, and will be arraigned on the new charges on Wednesday inside the same courthouse that the slain judge, John Roll, presided. Some legal experts are calling the new charges overkill. Attorney Judy Clarke, who has helped several notorious defendants avoid death sentences, including Eric Robert Randolph, the Atlanta Olympics bomber, and Ted Kaczynski, the Unabomber, will defend Loughner.
