In transferring five high-ranking Taliban members out of Guantanamo Bay in exchange for Sgt. Bowe Bergdahl’s freedom, the Department of Defense violated the law. The U.S. Government Accountability Office issued a decision Thursday that determined that the transfer violated section 8111 of the Department of Defense Appropriations Act, 2014 by not providing at least 30 days' notice to certain congressional committees of the pending release. The 30-day notification is required to transfer Guantanamo detainees using appropriated funds.
